Terms of Service

The fine print, simplified. These terms govern your use of the Nexysys Desktop Agent and Dashboard.

1. Acceptance of Terms

By downloading, installing, or using the Nexysys software, you agree to be bound by these restrictions and requirements. If you are using Nexysys on behalf of an organization, you are agreeing to these terms for that organization and promising that you have the authority to bind that organization to these terms.

2. License & Rights

Nexysys grants you a limited, non-exclusive, non-transferable, revocable license to use our Desktop Agent solely for your internal business purposes. You allow Nexysys to collect specific telemetry data (as outlined in our Privacy Policy) to generate the reports and dashboards that constitute our Service.

You retain full ownership of your data. We retain full ownership of the Nexysys software, algorithms, and aggregated/anonymized benchmarking data.

3. Acceptable Use

You agree not to misuse the Nexysys services. For example, you must not:

  • Reverse engineer or decompile the Nexysys Desktop Agent.
  • Use the Service to track employees without their knowledge or consent (we require transparency).
  • Probe, scan, or test the vulnerability of any system or network.

4. Payment & Billing

For paid workspaces, you will be billed on a recurring basis (monthly or annually). We reserve the right to suspend access to your workspace if payment is past due. You may cancel your subscription at any time; however, no refunds will be provided for partial months of service.

5. Limitation of Liability

To the maximum extent permitted by law, Nexysys Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.

Our Service is provided "AS IS" and "AS AVAILABLE." We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

6. Changes to Terms

We may modify these Terms at any time. If we make changes that are material, we will let you know by sending you an email or posting a notice on our website before the changes take effect.
